Moodle 2 Custom Theme Package Pricing
The cost of a custom theme from NewSchool Learning has always been determined by a conservative estimate of the time it would take to complete the work from start to finish.
NewSchool Learning grants you non-exclusive limited license to use the designs and services sold through this site (the "products") in accordance with these terms and conditions (the "license").
By purchasing our products, you are free to use our designs on any website that you, the purchaser, personally owns or manages.
You can make any necessary modification(s) to our designs to fit your purposes.
You may not place any of our products, modified or unmodified, on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent from NewSchool Learning.
You may not sub-license or transfer this license to anyone else without the prior written consent of NewSchool Learning.
You may not claim intellectual or exclusive ownership of any of our products, modified or unmodified. All designs remain the property of NewSchool Learning unless the design came from a third-party, such as another designer or an existing website. In such cases, we make no claim of ownership whatsoever. We do place a small, discrete link back to our website in the footer of all our designs. As part of our modification policy above, you are free to remove it. However, it would be great if you didn't. If you do remove the link back to NewSchool Learning, the design must remain "unbranded" - without credit for the design going to anyone.
The products and services sold on this site are provided "as is" without warranty of any kind, either expressed or implied. In no event shall we be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of our inability to use our products.
Since the products are non-tangible and irrevocable goods, we do not issue refunds once download access has been granted, which you are responsible for understanding upon purchasing. Please make sure that you've carefully read all documentation, and tried out the demo. We will only make exceptions with this rule when the product appears to be not-as-described on a case by case basis in agreement of the parties concerned. The deadline for any refund claim is one week (7 calendar days) after the product has been purchased.
Moodle is open source software covered by the GNU General Public License. As such, all PHP and HTML files in our products containing markup and calls to and from GPL software fall under the GPL, too. Anyone is free to use and distribute such files with all the freedoms that the GPL allows. In all cases, however, the designs themselves remain completely independent of the software, as evidenced by the fact that a.) the designs existed prior to and separate from the software, b.) the same design can be used on any software platform or raw HTML webpage, and c.) theme designs are not compiled by the software but are sent independently of GPL code, and combined in a client's browser. Therefore, we reserve all rights to protect our designs by restricting use of the CSS and image files included in our products.
THIS LICENSE SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF INDIANA, WITHOUT REGARD TO CONFLICTS OF LAWS PROVISIONS. BY PURCHASING OUR PRODUCTS, YOU AGREE AND CONSENT THAT THE SOLE AND EXCLUSIVE JURISDICTION FOR ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATING TO THIS LICENSE SHALL BE AN APPROPRIATE STATE OR FEDERAL COURT LOCATED IN THE STATE OF INDIANA.
NewSchool Learning reserves the right to change or modify these terms with no prior notice.
